Legal Considerations in Insurance Investigation & Surveillance - Course Synopsis: This is a one hour to one and half hour presentation of Federal and State Criminal laws that can affect how an insurance surveillance and investigation is carried out by field investigators on behalf of adjusters. Sections of Florida Insurance Statutes 626 and 440 authorizing or requiring an adjuster to conduct investigations of claims are briefly reviewed as is a section of Florida Statute 493 regulating Private Investigators. There is brief discussion of the definition of a successful surveillance and what constitutes good evidence and how it is best utilized. The main emphasis of the presentation is the impact of The Federal Fair Credit Report Act (FCRA), Graham Leach Riley Financial Privacy Act, Health Insurance Portability and Accountability Act (HIPAA), Federal Communications Privacy Act and Florida State Statutes concerning Stalking/Harassment, Fraudulent Practices (Misrepresentation) and Trespass. The areas of these laws that affect investigations and surveillance are presented in interactive practical application scenarios to demonstrate the possible impact.
